What happens with a 1099-A when it comes to a divorce? Who declares it on their tax return?

My ex-husband received one of our homes in the divorce. It then foreclosed on in April 2010. I was finally able to get a copy of the 1099-A. It has both our names on it, but it shows my social security number on it. Since it was his home, does he declare this on his tax return or since it has my SSN, do I declare it? There was a loss and box 5 has a X in No. What do I do?
